Indian Patent Agent Examination 2023 – Notification

The Controller General of Patents, announced that the notification of the next Patent Agent Examination would be published on the official website- www.ipindia.gov.in on 15/11/2022 as per Public Notice No. CGPDTM-14020/10/2021-CGOFFICE/234 DATED 01/08/2022.

INSTITUTE OF PATENT ATTORNEYS, INDIA [IPAI] is providing professional training in Patent Law and Practice for candidates to appear for the Indian Patent Agents Examination 2023, conducted by the Ministry of Commerce and Industry (Govt. of India) through Patent Offices and obtaining qualifications necessary to practice as a Patent Agent under the Patent Act and Rules.

PATENT AGENTS/ATTORNEYS

Patent Agents, also called Patent Attorneys are specialised Legal Advisors, similar to Lawyers, who advise their clients on how to protect their Intellectual Property Rights. The
Patent Attorneys work either in Private Firm of Patent Attorneys or in Patent Departments of large Industrial organisations, Public Research Institutes etc. Patent Attorney’s day-to-day work generally involves the drafting of patent specifications, applying for patents, subsequent correspondence with the patent office on the objection raised/ office actions/filing response to patent examination reports; representing the Applicant’s case to the hearing, filing opposition proceedings or defending an application against an opposition, all being of a highly technical

nature is ordinarily entrusted to a qualified patent Agent. For the purpose of maintaining a high standard of efficiency and professional integrity, the Patent Act has prescribed certain qualifications for persons practising as Patent Agents and provided for their registration. The only person who satisfies that qualification and is registered under the Patents Act is allowed to practice as Patent Agent in India.

CAREER SCOPE FOR PATENT AGENTS.

  1. Patent Agents can file International Patent Applications (PCT) on behalf of Indian
    applicants.
  2. Foreign Applicants can file Patent in India through an India Patent Agent only
  3. Patent Specification Drafting is outsourced to Indian Patent Agents from the USA, Canada, Australia and Europe.
  4. Patent Agent can work as a Freelancer in Patent Specification drafting for Indian &
    Foreign IP Law Firms.
  5. Very Attractive Remuneration/Salary package for Patent Agents in India, in
    Biotechnology, Pharmacy and Engineering R&D Firms.
  6. Patent Agents can start their own IP Law Firms and Consultancy Services
  7. A chance to work English Speaking Foreign Law Firms as In-House Drafting Attorney.

PLACEMENT

The Institute of Patent Attorneys Shall provide placement assistance to those who successfully cleared the Patent Agent Examination conducted by the Controller of Patents. Patent Agents/Attorneys have an ample number of job opportunities in Intellectual Property Law Firms, KPO/LPO, as well as Corporate Organizations. They can choose channels like in-house Advisors for different organizations or start their own Attorney’s Firms and Consultancy Services.

SPECIAL INTERNSHIP OFFER FOR INSTITUTE OF PATENT ATTORNEYS, INDIA CANDIDATES

Institute of Patents Attorneys, India is providing a one to three months Professional Internship Programme under Dr. R K Nair, Sr. Patent Attorney; after clearing of Patent Agent Exam 2023, Every candidate shall be eligible to get a minimum of 5 hearings before the Controller of Patents along with Dr R K Nair, the candidates can include the hearing details in their CV. A separate internship certificate shall also be issued to participants.

Dr. R K Nair is a Sr. Patent Attorney, and He graduated in Law, BA(Law)-LL. B, the first batch of five years integrated LLB during 1984-89 at Govt. Law College, Calicut University.
He has got a Master in Law (IPR) from the School of Law and Legal studies, GGSIP
University, Delhi and Ph D (Patent Law, Thesis title: ‘A Critical Study of Post Trips Patent
Regime in India’) from Northcap University, Gurugram. Dr. Nair enrolled as an Advocate in
the year 1990 before the Bar Council of Kerala and became a life member of the Kerala High Court Advocates’ Association, and started practice before the Kerala High Court. He also enrolled as a Patent Agent before the Controller General Patents, Trade Marks & Design. The President of India was pleased to appoint him as Addl. Central Govt. Standing Counsel (1996-99) at the High Court of Kerala. In the year 2005, Mr Nair shifted his practice to New Delhi.

IPR Training abroad – Dr R K Nair attended the Executive Program “Strategic Intellectual Property Finance” WIPO ACADEMY, Geneva, in 2007;

The JPO/IPR Training Course for ‘Patent Experts’ at Japan Patent Office, Tokyo in 2010, and
he has completed an Advanced course on Arbitration and Mediation Procedure under the
WIPO Rules, WIPO ACADEMY. Being the Faculty of the Institute of Patent Attorneys,
India Dr. Nair has trained more than 1000 Patent Agents since 2005, and he was visiting
professor at the Netaji Subhas University of Technology, Delhi (Formerly NSIT, Delhi
University) and Northcap University, Gurugram and others.

WHO ARE ELIGIBLE?

Degree holders in Science (All Science subjects), Pharmacy, Engineering, and Technology. [No Age Bar]

EXAM SYLLABUS:

The qualifying examination shall consist of the following papers and marks, namely: –
Paper I – Patent Act and Rules-100 marks,
Paper II – Drafting and interpretation of Patent specification and other documents -100 marks and Viva-Voce 50 marks: Total 250 Marks.

PATENT AGENT EXAM STRUCTURE

Paper -I (Two Hours) Objective type; Multiple Choice Questions having one and/or more
than one option correct.
Paper-II (Three Hours) Descriptive and

Viva-Voce. The schedule for the Viva-Voce examination will be announced after the completion of the written exam. Only those candidates who have scored a minimum of 50% marks in each paper will be allowed to appear for Viva-Voce.

A candidate shall be required to secure a minimum of fifty marks in Paper-I and Paper-II and shall be declared to have passed the examination only if he obtains an aggregate of sixty per cent of the total marks.
